Which government agency has to clear your import?

Twelve agencies, across thirteen programmes, can put a hold on a shipment. CBP publishes a three-character flag against the tariff line, so you know which agency is interested before you file rather than after. This page decodes every flag in CBP's current table, says what each agency actually wants, and is explicit about the difference between a flag that means data may be required and one that means it is.

Read this before you read a code

A flag is not a determination. A code on your entry means the tariff line is flagged and the agency may want data. The same HTS provision often covers goods that are regulated and goods that are not, and composition, intended use and origin decide which yours is. Codes that do require the data are marked separately throughout this page. Nothing here tells you your shipment will clear.

Eight agencies

They need data on the filing

You transmit their message set with the entry. JFS files these directly.

FDA

Food and Drug Administration

They need data on the filing

required: FD2required: FD4may be required: FD1may be required: FD3

What it regulates
Food, dietary supplements, drugs, medical devices, cosmetics, tobacco and e-cigarettes, radiation-emitting products and veterinary products.
How you know you are flagged
FD1 and FD3 mean data may be required — the line is flagged and the goods decide. FD2 and FD4 mean the data is required. All four cover eight FDA programmes, from foods to tobacco, so which of them applies depends on what the goods are.
What must be filed, and when
Prior notice before arrival for food. The message set transmits with the entry. A shipment that arrives without prior notice is held, not merely delayed.
What goes wrong most often
Supplements and vitamins are food to FDA, so the prior notice rule reaches them. Sellers routinely declare them as something else.
When it arrives by mail
Food sent without prior notice does not get the usual 30 days. It is held 72 hours, after which it can be destroyed or exported.

What the manufacturer or seller has to supply

This data starts with whoever made or sold the goods, in every mode. What changes is how it reaches the filing: on a mail parcel through the origin post's electronic data, otherwise through the shipper's documents. Seller means it can only come from them; seller + filer means we supply or confirm part of it. Ask for it at order time — it is far harder to get once the goods have shipped.

APHIS

USDA Animal and Plant Health Inspection Service

They need data on the filing

required: AQ2may be required: AQ1may be required: AQX

What it regulates
Plants, plant products, live animals, animal products, soil, and wood packaging material.
How you know you are flagged
AQ1 means agricultural quarantine interest on the line. The same HTS provision covers regulated and unregulated commodities, so the goods decide.
What must be filed, and when
Permit numbers and the quarantine data set with the entry. Some commodities need an import permit obtained before shipment.
What goes wrong most often
Wood packaging is regulated separately from the goods inside it. ISPM 15 marking is checked on the pallet, not the product.
When it arrives by mail
A plant or seed parcel without a permit is not held for correction. It is refused.

What the manufacturer or seller has to supply

This data starts with whoever made or sold the goods, in every mode. What changes is how it reaches the filing: on a mail parcel through the origin post's electronic data, otherwise through the shipper's documents. Lacey Act

USDA APHIS Lacey Act, plants and wood

They need data on the filing

required: AL2may be required: AL1

What it regulates
Plant and wood content in manufactured goods: furniture, flooring, paper, musical instruments, handles and trim.
How you know you are flagged
AL2 is a declaration requirement, not an advisory flag. If the line is enumerated, the declaration is filed. AL1 is the advisory half of the pair.
What must be filed, and when
A Lacey Act declaration naming genus, species, country of harvest, quantity and value of the plant material.
What goes wrong most often
Importers declare the finished article and omit the wood component. The declaration is about the material, not the product.
When it arrives by mail
Rarely reaches mail volumes, but a wooden instrument or carved item in a parcel is in scope.

AMS

USDA Agricultural Marketing Service

They need data on the filing

required: AM2required: AM4required: AM6required: AM8may be required: AM1may be required: AM3may be required: AM7

What it regulates
Grade, size, quality and maturity standards for specified fruits, vegetables and specialty crops under marketing orders.
How you know you are flagged
AM3 is advisory on the line and AM4 is the required half; whether the order reaches your goods depends on the commodity and the season. AM7 and AM8 are a different AMS programme, organics, and AM8 is required. AM1 and AM2 cover eggs, AM6 peanuts.
What must be filed, and when
An inspection certificate or an exemption claim, depending on the commodity and quantity.
What goes wrong most often
Small lots are often exempt, but the exemption has to be claimed rather than assumed.
When it arrives by mail
Marketing orders are written for commercial volumes. A personal parcel is usually out of scope, but the flag still appears.

CPSC

Consumer Product Safety Commission

They need data on the filing

required: CP2may be required: CP1

What it regulates
Children's products, toys, cribs, mattresses, lighters, and consumer goods subject to a mandatory safety standard.
How you know you are flagged
CP2 means the certificate data is required on the filing; CP1 is the advisory half.
What must be filed, and when
A Children's Product Certificate or a General Certificate of Conformity, identifying the standard and the testing laboratory.
What goes wrong most often
The certificate must name the specific rule tested against. A generic conformity statement is not a certificate.
When it arrives by mail
A toy parcel without certificate data is held pending the data, not refused outright.

FWS

U.S. Fish and Wildlife Service

They need data on the filing

required: FW2may be required: FW1may be required: FW3

What it regulates
Wildlife and wildlife products: skins, feathers, shell, coral, ivory, taxidermy, and some cosmetics and supplements with animal content.
How you know you are flagged
FW2 means the declaration data is required. FW1 and FW3 are advisory, and are two of the four flags whose disclaim codes CBP restricts: FW1 to C, D or E, FW3 to C or D.
What must be filed, and when
Form 3-177 declaration, and a CITES permit where the species is listed.
What goes wrong most often
People assume a souvenir is exempt. Scale and intent do not remove the declaration requirement.
When it arrives by mail
Wildlife in mail is a common seizure. A shell or coral item bought on holiday is in scope.

NMFS

NOAA Fisheries, National Marine Fisheries Service

They need data on the filing

required: NM2required: NM4required: NM6required: NM8may be required: NM1may be required: NM3may be required: NM5

What it regulates
Seafood species covered by the Seafood Import Monitoring Program, plus tuna and swordfish documentation.
How you know you are flagged
NM8 means Seafood Import Monitoring Program data is required for the listed species. NM1 and NM2 are the Form 370 pair, NM3 and NM4 Antarctic Marine Living Resources, NM5 and NM6 Highly Migratory Species.
What must be filed, and when
Harvest and landing data traceable to the vessel, with an International Fisheries Trade Permit held by the importer.
What goes wrong most often
The permit belongs to the importer of record and has to exist before the entry, not after.
When it arrives by mail
Seafood rarely moves by mail, but dried and preserved forms do and are in scope.

NHTSA

National Highway Traffic Safety Administration

They need data on the filing

required: DT2may be required: DT1

What it regulates
Motor vehicles and regulated vehicle equipment: lighting, glazing, tyres, brake hose, child restraints.
How you know you are flagged
DT1 is advisory. Whether the item is regulated equipment depends on what it is and whether it is for road use. DT2 is the required half.
What must be filed, and when
Form HS-7 declaration selecting the conformance box that applies.
What goes wrong most often
Off-road and display-only claims are checked. The box selected is a statement, not a preference.
When it arrives by mail
A replacement lamp or a child seat in a parcel is regulated equipment.

Two agencies

Usually answered with a disclaim

A negative declaration satisfies the flag when the goods are out of scope, and a wrong disclaim is still a false statement to CBP. Note that this is not a privilege of these two: CBP's default is that disclaim codes are allowed for every PGA unless noted in that agency's Implementation Guide or called out in the flag table. The flag table itself restricts only EH1, TB3, FW1 and FW3 — but the Implementation Guides carry their own limits, so check the agency's guide before relying on a disclaim.

EPA

Environmental Protection Agency

Usually answered with a disclaim

required: EP2required: EP4required: EP6required: EP8required: EH2may be required: EP1may be required: EP3may be required: EP5may be required: EP7may be required: EH1

What it regulates
Chemical substances under TSCA, pesticides and devices under FIFRA, and engines and vehicles under the Clean Air Act.
How you know you are flagged
EP7 is the TSCA flag and is advisory; EP8 is its required half. EP1 is ozone-depleting substances, EP3 vehicles and engines, EP5 pesticides, EH1 hydrofluorocarbons. A TSCA line is most often satisfied by a negative certification: the goods are not subject to TSCA.
What must be filed, and when
A positive or negative TSCA section 13 certification, or the applicable EPA form for pesticides and engines.
What goes wrong most often
The negative certification is a statement that the goods are out of scope. Signing it without checking is the error.
When it arrives by mail
A chemical or pesticide parcel without certification is held, and pesticides are frequently refused.

What the manufacturer or seller has to supply

This data starts with whoever made or sold the goods, in every mode. What changes is how it reaches the filing: on a mail parcel through the origin post's electronic data, otherwise through the shipper's documents. DEA

Drug Enforcement Administration

Usually answered with a disclaim

may be required: DE1may be required: DE3

What it regulates
Controlled substances and listed chemicals that can be used to manufacture them.
How you know you are flagged
DE1 is advisory, and so is DE3, which covers regulated machines. DEA is the one agency in CBP's table with no required flag at all. Most flagged lines are not controlled, but the ones that are need a registration and a permit.
What must be filed, and when
DEA registration and an import permit or declaration, depending on the schedule.
What goes wrong most often
A substance legal in the origin country may be scheduled here. Origin legality is not the test.
When it arrives by mail
A controlled substance in mail is a law enforcement matter, not a clearance problem.

What the manufacturer or seller has to supply

This data starts with whoever made or sold the goods, in every mode. What changes is how it reaches the filing: on a mail parcel through the origin post's electronic data, otherwise through the shipper's documents. Three agencies

Inspection and permits, not just data

These three turn on a permit, a certificate or an inspection at arrival, so the filing is the start of the process rather than the end of it. CBP's flag table attaches no entry type to any flag, so nothing here says a flag forces a formal entry. Mail is the one place the entry type does change on a date: for a parcel subject to another agency's requirements, 19 CFR 145.12(a)(2)(v) carries a compliance date of 20 January 2027, and up to 19 January 2027 CBP permits those shipments to use the postal informal process instead.

FSIS

USDA Food Safety and Inspection Service

Inspection and permits, not just data

required: FS4may be required: FS3

What it regulates
Meat, poultry and egg products, including many prepared foods containing them.
How you know you are flagged
FS4 means FSIS data is required on the filing; FS3 is the advisory half. CBP's table applies both to all FSIS programmes.
What must be filed, and when
Foreign inspection certificate and entry at an approved import inspection establishment.
What goes wrong most often
Commercial quantities get no break on inspection. But there IS a personal-consumption exemption, which is the thing most often got wrong in both directions: 9 CFR 327.16 lets an importer bring in 50 pounds or less of meat bought abroad for their own consumption without the rest of the import part, and 9 CFR 381.207 does the same for poultry under 50 pounds for the consignee's personal use — no foreign inspection certificate either way. Country and disease restrictions under 9 CFR part 94 still apply, and those are what actually stop most of these.
When it arrives by mail
Meat and poultry by mail is usually stopped, but by APHIS country and disease rules under 9 CFR part 94 rather than by a blanket FSIS ban, and 9 CFR 381.207 expressly allows a qualifying personal-use poultry shipment through. Where product is refused, destruction is one outcome among several — it may also be exported or returned.

State Dept

State Department, Office of Marine Conservation

Inspection and permits, not just data

required: OM2may be required: OM1

What it regulates
Tuna and tuna products subject to international conservation programmes, and related marine documentation.
How you know you are flagged
OM2 means the Office of Marine Conservation data is required on the filing; OM1 is the advisory half.
What must be filed, and when
The applicable conservation certificate, matched to the harvest documentation.
What goes wrong most often
The certificate has to match the harvest record. A mismatch is treated as a missing certificate.
When it arrives by mail
Not a mail commodity in practice.

What the manufacturer or seller has to supply

This data starts with whoever made or sold the goods, in every mode. What changes is how it reaches the filing: on a mail parcel through the origin post's electronic data, otherwise through the shipper's documents. TTB

Alcohol and Tobacco Tax and Trade Bureau

Inspection and permits, not just data

required: TB2may be required: TB1may be required: TB3

What it regulates
Distilled spirits, wine, beer and tobacco products.
How you know you are flagged
TB2 is the required flag and TB1 the advisory one. TB3 is also advisory but can only be disclaimed with code A or C.
What must be filed, and when
For a commercial importation: the importer's basic permit, a certificate of label approval, and the excise tax calculation on the entry. A one-off personal importation is treated differently, and the mail route is closed to alcohol regardless.
What goes wrong most often
A gift of wine is still an import. The permit requirement attaches to the commercial importation, not the sentiment.
When it arrives by mail
Alcohol cannot move through the international mail at all: 18 USC 1716(f) makes intoxicating liquor nonmailable, and no customs entry changes that. Cigars are a separate question under 18 USC 1716E, which bars cigarettes and smokeless tobacco but not cigars.

ACE program codes, decoded

Every flag in CBP's table, and the ones our own classifier hands back — ask it about honey and it returns AQ1, AM7 and FD4. Each row says which agency is interested, which of its programmes, and whether the data is required or only may be. Most flags come in pairs that share a programme, one “may be required” and one “required” — but read the state off the row rather than off the number: AQX carries no digit at all, and NM8, AM6, DE1 and DE3 have no partner.

Transcribed from ACE Agency Tariff Code Reference, CBP Pub # 0875-0419, revision of 4 March 2026 — all 49 flags it publishes. The source document is here. CBP revises the table by CSMS notice, so check the revision date against CBP's before relying on a code for a filing. CBP allows every disclaim code for every PGA unless the flag table says otherwise or the agency's Implementation Guide does. The flag table's own exceptions are listed above; the Implementation Guides are not reproduced here.
